Terms of Service / End User License Agreement (EULA)

Welcome to Yomou. Please read these Terms of Service carefully before using our application. This Agreement is a legally binding contract between you and Lexivant LLC governing your use of our software.

Who We Are and What This Agreement Covers

We are Lexivant LLC, a limited liability company organized under the laws of the Commonwealth of Puerto Rico (USA). This Terms of Service agreement ("Terms" or "Agreement") governs your access to and use of:

1. Our mobile application, Yomou (the "App").
2. Our official websites located at https://lexivant.studio and https://yomou.app (including any related subdomains).
3. Any services, data synchronization features, or software utilities provided by Lexivant LLC (collectively, the "Services").

By creating an account, purchasing a subscription, or utilizing the App, you explicitly acknowledge that you have read, understood, and agreed to be bound by these Terms. If you do not agree to these Terms, do not install or use the App.

1. Eligibility and User Accounts

• Age and Capacity: You must be at least 18 years old, or the age of legal majority in your country or jurisdiction of residence, to create an account and enter into these Terms on your own behalf. If you are a minor below the age of majority but at or above the minimum age permitted in your jurisdiction (and in no event under the age of 13), you may use the App only with the involvement and consent of a parent or legal guardian who agrees to be bound by these Terms on your behalf. The App is not directed to, and we do not knowingly permit account creation by, children under the age of 13. You represent and warrant that you meet these requirements.
• Account Responsibility: To utilize cross-device library synchronization, you are required to establish an account via Google Firebase Authentication. You are solely responsible for maintaining the confidentiality of your authentication tokens and account data, and for all activity that occurs under your account. Lexivant LLC does not maintain plaintext passwords and cannot recover accounts due to lost third-party identity credentials.

2. Intellectual Property and Content Rules

• App License Grant: Lexivant LLC grants you a limited, non-exclusive, non-transferable, revocable license to download, install, and use Yomou for personal, non-commercial purposes on mobile devices owned or controlled by you. All rights not expressly granted are reserved by Lexivant LLC.
• User-Provided Content & Material: Yomou is a platform utility. You retain full ownership of any content, images, or documents you load into the App or submit for text-recognition processing.
• Copyright & Prohibited Content: You explicitly agree not to use Yomou to store, view, translate, or distribute materials that infringe upon third-party intellectual property or copyrights, or that are otherwise unlawful. Lexivant LLC does not host, provide, or index manga content; you are entirely responsible for the legality of the materials you view within the reader.
• Copyright Complaints: If you believe that material accessed or processed through the App infringes your copyright, you may notify us at hello@lexivant.studio with sufficient detail to identify the material and your claim. We will review and respond to valid notices as required by applicable law, and may remove access or take other appropriate action.

3. AI Features, OCR Processing, and Software Limitations

• OCR and Text Generation Utility: Yomou provides automated text recognition utilizing local device hardware and cloud processing pipelines (Google Firebase / Vertex AI). Text extraction and synthetic Text-to-Speech (TTS) audio rendering are provided strictly "as-is" for personal utility.
• Accuracy and Liability Limitations: Lexivant LLC makes no warranties regarding the literal accuracy, contextual precision, or cultural fidelity of the text recognized or rendered by our automated utilities. Lexivant LLC is not liable for errors, data omissions, or damages resulting from your reliance on automated textual or voice output inside the App.

4. Subscriptions, Billing, and Purchases

• Platform Billing: Any premium tiers, feature unlocks, or recurring subscriptions offered inside Yomou are billed exclusively through the applicable platform payment systems (Apple App Store In-App Purchases or Google Play Store Billing). All purchase histories, transaction processing, and payment credentials are managed securely by Apple or Google; Lexivant LLC has no access to your financial data.
• Cancellations and Refunds: Subscriptions auto-renew until cancelled through your native platform account settings. Refund requests must be directed to Apple or Google pursuant to their respective policies. Lexivant LLC cannot directly grant refunds or modify subscription records held by the platforms.

5. Platform-Specific Provisions

Your license to install and use the App may be subject to additional terms imposed by the platform through which you obtained it.

• Apple App Store (iOS): If you obtained the App from the Apple App Store, your license to install and use the App is additionally governed by Apple's standard Licensed Application End User License Agreement (the "Apple Standard EULA"), available at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. To the extent these Terms conflict with the Apple Standard EULA solely with respect to the license to use the App on Apple-branded devices, the Apple Standard EULA shall control for App Store downloads. You acknowledge that these Terms are concluded between you and Lexivant LLC only, and not with Apple, and that Apple is not responsible for the App or its content. All other provisions of these Terms — including those governing accounts, subscriptions, acceptable use, disclaimers, indemnification, and termination — continue to apply.
• Google Play (Android): Google does not provide a standard end user license agreement. If you obtained the App from the Google Play Store, these Terms constitute the complete and binding end user license agreement between you and Lexivant LLC governing your license to install and use the App, in addition to any applicable Google Play terms.

6. Disclaimer of Warranties and Limitation of Liability

• Disclaimer of Warranties: THE APP AND SERVICES ARE PROVIDED TO YOU ON AN "AS-IS" AND "AS-AVAILABLE" BASIS, WITH ALL FAULTS AND WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, LEXIVANT LLC DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.
• Limitation of Liability: TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL LEXIVANT LLC, ITS FOUNDERS, OR ITS CONTRACTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING OUT OF OR IN CONNECTION WITH YOUR ACCESS TO OR USE OF THE SOFTWARE.
• Liability Cap: TO THE EXTENT LIABILITY CANNOT BE FULLY EXCLUDED, LEXIVANT LLC'S TOTAL AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THE APP OR THESE TERMS SHALL NOT EXCEED THE GREATER OF (A) THE TOTAL AMOUNTS YOU PAID, IF ANY, ATTRIBUTABLE TO THE APP IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS (USD $100.00).
• Mandatory Rights: Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages. In such jurisdictions, the above exclusions and limitations apply only to the extent permitted by law, and nothing in these Terms limits any rights you may have that cannot be lawfully waived.

7. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify, defend, and hold harmless Lexivant LLC, its founders, and its contractors from and against any claims, damages, liabilities, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use or misuse of the App; (b) your violation of these Terms; (c) your violation of any applicable law or any third-party right, including any intellectual property or copyright right; or (d) any content, images, or materials you load, store, view, translate, or process within the App.

8. Privacy

Your use of the App is also governed by our Privacy Policy, available at https://lexivant.studio/privacy and https://yomou.app/privacy, which explains how we collect, use, and process your information. By using the App, you acknowledge that you have reviewed the Privacy Policy.

9. Specific Regional Provisions

Nothing in these Terms limits or waives any mandatory statutory consumer protections that apply to you under the laws of your country or jurisdiction of residence and that cannot be waived by private agreement. Where such mandatory protections conflict with these Terms, those protections prevail to the extent required by law. This includes, without limitation, protections available to consumers in the United States under applicable state law, in Mexico under the Ley Federal de Protección al Consumidor, and in Argentina and Chile under their respective consumer protection statutes.

10. Term, Termination, and Changes

• Termination by You: You may stop using the App and delete your account at any time, as described in our Privacy Policy and within the App's settings menu.
• Termination by Lexivant LLC: Lexivant LLC may suspend or terminate your account or access to the App, in whole or in part, at any time and without prior notice, if you violate these Terms, use the App unlawfully, or engage in conduct that may harm other users, third parties, or Lexivant LLC.
• Changes to These Terms: Lexivant LLC reserves the right to modify these Terms at any time. We will post modified versions openly on our websites and highlight revisions through in-App notifications. Your continued use of the App following the posting of updated Terms confirms your acceptance of the revised text.

11. Governing Law and Jurisdiction

These Terms and your relationship with Lexivant LLC under this Agreement shall be governed by, and construed in accordance with, the laws of the Commonwealth of Puerto Rico (USA), without regard to its conflict of law principles. Except where prohibited by local consumer protection statutes that mandate local venue, any legal action, dispute resolution mechanism, or proceeding arising under this Agreement shall be brought exclusively in the courts located in Puerto Rico.

This Agreement may be made available in other languages, including Spanish, for your convenience. In the event of any conflict, ambiguity, or discrepancy between the English-language version and any translated version, the English-language version shall prevail and control, except where applicable local law requires that a translated version govern.
